International Arbitration Lawsuit Involving Bank Century 'Fugitives' Not Even Begun Yet

Arbitrations in the lawsuit filed against Indonesia by the former shareholders of Bank Century, fugitives Rafat Ali Rifzi and Hesham al Warraq, have not commenced, a lawyer who represents the government has said.

Chartered arbitrator Karen Mills from the Jakarta-based Karim Syah law firm said on Thursday that any information stating that Indonesia had lost in the international arbitration lawsuit was false, since even the tribunals of the arbitrators that will decide them have not yet been fully appointed.

"Such a suit would normally last a minimum of two years, and a maximum of four. Nothing has begun as yet. Information that fugitives [Ali Rifzi and al Warraq] have won is absolutely nonsense," Mills told TEMPO English Edition on Thursday evening.

An official statement obtained by TEMPO from the Attorney General's Office states that no documents have been submitted as yet in regard to the suit, and are not likely to be fore more than a month.

"International investor-state arbitrations are confidential and they take a long time. The government will announce the results as and when they are issued. We are confident that we have a very strong case and expect to win," the statement said. Both Ali Rifzi and al Warraq filed the suit at the US's International Center for Settlement Investment Dispute, or ICSID. The fugitives, who have been sentenced to a 15-year jail term by an Indonesian court for the roles they played in the collapse of Bank Century, have sued Indonesia, claiming losses from their investments in the bank as a result of being slapped with criminal charges.
